1. ACCEPTANCE OF TERMS
These Terms of Service ("Terms") govern your use of the website yespacva.com, all forms and pages hosted by Yes PAC ("Yes PAC," "we," "us," or "our"), and any related services including email, SMS, donations, events, and volunteer programs (collectively, the "Services").
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy at www.yespacva.com/privacy. If you do not agree, do not use the Services.
2. ABOUT YES PAC
Yes PAC is a Virginia state political action committee registered with the Virginia State Board of Elections (Committee ID: PAC-24-00062). Yes PAC's mission is to support and advance the policy priorities and political engagement of Virginians through advocacy communications, organizing, and grassroots fundraising.

Yes PAC is not affiliated with, controlled by, or coordinated with any candidate, candidate's committee, party committee, or other political organization. Contributions to Yes PAC are independent expenditures of Yes PAC and are not made at the direction of any candidate.
3. ELIGIBILITY
You may use the Services only if you are at least 13 years old. To contribute to Yes PAC, you must additionally:
• Be at least 18 years of age
• Be a U.S. citizen or lawfully admitted permanent resident
• Be making the contribution from your own personal funds (not those of a corporation, labor union, foreign national, or another person)
• Not be a federal contractor
You are responsible for ensuring you meet these requirements before contributing. False attestations may result in refund of your contribution and reporting to applicable authorities.
4. ACCEPTABLE USE
You agree NOT to use the Services to:
• Violate any law or regulation, including campaign finance laws
• Impersonate another person or misrepresent your identity, citizenship, or eligibility to contribute
• Submit false, misleading, or inaccurate information
• Attempt to gain unauthorized access to our systems or other users' data
• Use automated tools (bots, scrapers) to interact with the Services without our prior written consent
• Harass, abuse, or threaten our staff, volunteers, or other supporters
• Send unsolicited commercial communications using information obtained from the Services
• Interfere with the proper functioning of the Services
We reserve the right to suspend or terminate access for any user who violates these Terms, refuse contributions from any source, and refund contributions at our discretion.
5. CONTRIBUTIONS
5.1 How contributions are processed
Donations are processed by our third-party payment processor, Anedot. By contributing, you also agree to Anedot's terms of service and privacy policy. Yes PAC does not store full payment card information on our systems.
5.2 Public disclosure
Important: You acknowledge and agree that Virginia law (and, where applicable, federal law) requires Yes PAC to report contributor information publicly, including:
• Your full name
• Your mailing address
• Your employer and occupation (if your aggregate contributions exceed $200 in a calendar year)
• The amount and date of each contribution
These reports are filed with the Virginia State Board of Elections and are publicly searchable. By contributing, you consent to this disclosure.
5.3 Contribution attestations
Each contribution to Yes PAC requires you to confirm that:
1. You are at least 18 years old
2. You are a U.S. citizen or lawfully admitted permanent resident
3. The contribution is made from your own personal funds, not advanced or reimbursed by another person or entity
4. You are not a federal government contractor
5. The contribution is not from a corporation, labor union, or foreign national
False attestations may be reported to applicable authorities.
5.4 Recurring contributions
If you sign up for a recurring monthly contribution, your payment method will be charged automatically each month until you cancel.
To cancel a recurring contribution: email yespac@yespacva.com with "Cancel Recurring" in the subject line. We will cancel future charges within 5 business days of receiving your request and send written confirmation.
You may also update your payment method or amount by emailing us or by contacting Anedot directly.
5.5 Refunds
Refund requests are reviewed on a case-by-case basis at the discretion of the treasurer. To request a refund, email yespac@yespacva.com within 30 days of the contribution. Payment processor fees may be non-refundable.
5.6 Tax status
Contributions to Yes PAC are not tax-deductible for federal or Virginia income tax purposes. Yes PAC is a political committee, not a 501(c)(3) charitable organization.
5.7 Anonymous contributions
Yes PAC does not accept anonymous contributions.
6. EMAIL COMMUNICATIONS
By providing your email address and opting in, you agree to receive emails from Yes PAC. These may include updates, advocacy alerts, event invitations, fundraising appeals, and other communications related to our work.
You may unsubscribe at any time by clicking the "Unsubscribe" link in any email. Some transactional emails (donation receipts, recurring notifications, account-related messages) may continue after unsubscribe.
7. SMS / TEXT MESSAGING TERMS
7.1 Program description
Yes PAC operates an SMS (text message) program to send advocacy alerts, event reminders, fundraising appeals, voter information, and similar communications related to Yes PAC's mission. By opting in, you consent to receive recurring autodialed text messages from Yes PAC.
7.2 Message frequency
You will receive messages no more than 5 per day.
7.3 Message and data rates
Message and data rates may apply. Charges are billed by and payable to your mobile carrier. Yes PAC is not responsible for any charges you incur from your carrier. Check with your carrier for details about your messaging plan.
7.4 How to cancel (opt out)
You can cancel the SMS service at any time. Just text "STOP" to 571-222-8090. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
7.5 How to get help
If at any time you forget what keywords are supported, just text "HELP" to 571-222-8090. After you send the SMS message "HELP" to us, we will respond with instructions on how to use our service as well as how to unsubscribe.

7.6 Supported carriers
The SMS program is available on most major U.S. mobile carriers, including but not limited to: AT&T, T-Mobile, Verizon, US Cellular, Sprint, Boost, Cricket, MetroPCS, and Google Fi.
7.7 Carrier liability
Carriers are not liable for delayed or undelivered messages.
7.8 Eligibility
You must be at least 13 years old and the account holder (or have the account holder's permission) to opt in to SMS messages.
7.9 Privacy
We will not share your mobile number with third parties for their marketing purposes. For full details on how we handle mobile information, see our Privacy Policy at www.yespacva.com/privacy.
7.10 Changes to this program
We may modify or terminate the SMS program at any time, with or without notice.
8. INTELLECTUAL PROPERTY
All content on yespacva.com - including text, graphics, logos, images, audio, video, and software - is owned by Yes PAC or its licensors and is protected by U.S. and international copyright, trademark, and other laws.
You may not copy, reproduce, distribute, modify, or create derivative works from any content without our prior written permission, except:
• Quoting brief excerpts for news reporting, commentary, or criticism consistent with fair use
• Sharing links to our public pages
• Forwarding our emails or SMS messages in their entirety to friends or family for non-commercial purposes
Yes PAC, our logo, and our hashtags are trademarks of Yes PAC.
8.1 User-submitted content
If you submit content to us (petition stories, testimonials, photos, volunteer applications, replies to our communications), you grant Yes PAC a non-exclusive, royalty-free, worldwide license to use, reproduce, edit, and publish that content in our communications and materials, with or without attribution.
You represent that you have all necessary rights to grant this license and that your submission does not violate any third party's rights.
9. THIRD-PARTY LINKS AND SERVICES
The Services may contain links to or integrate with third-party websites, applications, or services (including Anedot for donations and social media platforms). These third parties have their own terms and privacy policies; we are not responsible for their content, practices, or any losses arising from your use of them.
10. DISCLAIMER OF WARRANTIES
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
• The Services will be uninterrupted, error-free, or secure
• Defects will be corrected
• The Services or the server that makes them available are free of viruses or other harmful components
• The information on the Services is accurate, complete, or current
You use the Services at your own risk.
11. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, YES PAC, ITS TREASURER, OFFICERS, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES - INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION - ARISING FROM YOUR USE OF THE SERVICES, EVEN IF YES PAC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our aggregate liability for any claim arising out of or relating to these Terms or the Services will not exceed the greater of (a) the total amount you have contributed to Yes PAC in the 12 months preceding the claim, or (b) one hundred dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Yes PAC and its treasurer, officers, volunteers, and agents from any claim, loss, liability, damage, or expense (including reasonable attorney's fees) arising from your violation of these Terms, your misuse of the Services, or your violation of any law or third-party rights.
13. GOVERNING LAW AND VENUE
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Prince William County, Virginia, and you consent to the jurisdiction of those courts.
These Terms do not include a mandatory arbitration clause or class action waiver. You retain all rights to bring claims in court individually or as part of a class action.
14. CHANGES TO THESE TERMS
We may modify these Terms at any time. The "Last Updated" date at the top will reflect the most recent revision. Material changes will be communicated via email or website notice when feasible. Your continued use of the Services after changes take effect indicates your acceptance.
15. SEVERABILITY
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
16. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy at www.yespacva.com/privacy, constitute the entire agreement between you and Yes PAC regarding the Services and supersede any prior agreements or understandings.
